Article 2 - INTRODUCTION

The purpose of these General Terms and Conditions of Sale (hereinafter ‘the GTC’) is to define the terms and conditions of sale of the products offered by 31 Degrés Boutique (hereinafter ‘the Products’) from its web site www.31degres.be (hereinafter ‘the web site’).

The Customer only purchases Products on a strictly personal basis. The Customer is therefore prohibited from purchasing the Products with a view to reselling them or for any other professional use.

Any order placed by the Customer automatically implies, without restriction or reservation, his/her irrevocable acceptance of the GTC. Thus, only the provisions of these GTC are binding between 31 Degrés Boutique and the Customer, to the exclusion of all others.

31 Degrés Boutique reserves the right to modify its GTC at any time, without prior notice. The new version of the GTC is applicable to orders placed from the date they are put online on the web site. 31 Degrés Boutique therefore recommends that its Customers regularly read the latest version of the applicable GTC.

Article 3 - PRODUCTS

3.1 SPECIFICATIONS

The essential features of the Products offered for sale by 31 Degrés Boutique are described on the web site www.31degres.be
The Products offered comply with current Belgian legislation and the standards applicable in Belgium. There are no spare parts for our products.

3.2 AVAILABILITY

Products are available for purchase while stocks last.
Stock is real (NO DROPSHIPPING) and is updated automatically.
When a Customer places an order on the Website, they are informed of the availability of the Products they wish to order.

Nevertheless, in the case of a Product ordered by the Customer eventually being out of stock, 31 Degrés Boutique will inform the Customer by email as soon as possible. Therefore :

  • if all the Products in the order are unavailable, the order will then be automatically cancelled and the Customer's bank account will be credited at the latest within 14 (fourteen) days following validation of the order,
  • if some of the Products in the order are unavailable, the Customer may then choose to replace the missing Product, maintain the order or cancel all or part of the order.

3.3 STOCK STATUS

There are 3 different categories that determine the availability of the item you want to purchase.

• IN STOCK :

If the item is in stock, you can click on the button to order it. The words ‘In stock’ appear next to ‘Availability’ on the product page, assuring you of its availability. The product is generally dispatched within 24/48 hours.

• AVAILABLE ON ORDER :

If the item is in supply: ‘Available on order’ is shown next to ‘availability’ on the product page. This means that we are waiting for delivery from our supplier before we can dispatch it to you, or that the order will be dispatched directly from our supplier.

For ‘available on order’ items, a restocking time is necessary. These items are available from our partners/suppliers.

Delivery times are therefore longer than for products in stock.

Delivery times for "available on order" items vary from 7 to 15 working days.

You will also be reminded of this in the order confirmation e-mail we send you. 

You will receive a tracking number for the parcel once it has been dispatched to the address you have given.

• OUT OF STOCK :

If our supplier is not yet able to provide us with an exact supply date, the words ‘Out of stock’ will be indicated.

3.4 QUANTITY

www.31degres.be is a retail sales website. It is not 31 Degrés Boutique's intention to sell to the Customer the Products offered in quantities exceeding the usual quantities intended to satisfy the Customer's private needs. Consequently, 31 Degrés Boutique reserves the right to refuse orders that are excessive in volume or frequency.

Article 4 - LEGAL AND COMMERCIAL GUARANTEES

4.1    GARANTIES LÉGALES

We guarantee that our products conform to your order and meet the normal expectations you may have, taking into account the product specifications. We also guarantee that our products comply with all laws in force at the time of your order.

En outre, concernant la livraison de biens vous jouissez du délai de garantie légale minimum de deux ans en cas de non-conformité du bien de consommation, c’est-à-dire lorsque le bien livré ne correspond pas à celui demandé ou commandé. Cela veut dire qu’en cas de défauts des biens qui sont découverts jusqu’à 2 ans suivant la livraison, les biens seront réparés, sinon remplacés. 

Vous avez le droit à la réparation ou au remplacement sans frais du bien (au choix du consommateur, mais en fonction de ce qui est possible et raisonnable). Uniquement dans le cas où la réparation ou le remplacement demande des efforts ou ressources disproportionné ou impossibles, ou ne peuvent pas être effectués dans un délai raisonnable, vous avez alors le droit d’exiger une réduction de prix ou le remboursement du produit.

If the defect is minor, you cannot demand a refund.

Si la constatation du défaut est faite dans les six premiers mois, le défaut est présumé exister depuis la livraison. Le vendeur doit prouver le contraire s’il n’est pas d’accord. Si la constatation est faite plus de six mois après la livraison, le consommateur est tenu de prouver l’existence de la non-conformité au moment de la livraison.

4.2    GARANTIE COMMERCIALE

All our watches come with a 2-year guarantee. Generally speaking, the guarantee covers manufacturing defects that occur during normal use of the product. This excludes

  • replacement of consumables (batteries, wristbands, etc.)
  • damage resulting from unusual or improper use of the products. In this respect, we invite you to carefully consult the instructions for use included with the product (watertightness level),
  • damage caused by the use of an unauthorised repairer.

Please note that the duration of the manufacturer's warranty may vary depending on the brand. The extent of a product's guarantee is detailed in the guarantee certificate accompanying each product.

A commercial guarantee is any contractual commitment by a professional to the consumer to reimburse the purchase price, replace or repair the goods, in addition to his legal obligations to guarantee the conformity of the goods.

Article 5 - PRICES AND PAYMENT TERMS

5.1    PRICE

The price of the Products is invoiced to the Customer on the basis of the price list in effect at the time the order is placed.
31 Degrés Boutique reserves the right to modify its prices at any time, without prior notice. The new prices are applicable to orders placed from the date they are put online on the www.31degres.be website.

The price of Products offered for sale on the Website is indicated in Euros, inclusive of tax.
Prices do not include delivery charges. Delivery costs are fixed. The amount of the delivery charge is indicated to the Customer before the order is validated.

 MEANS OF PAYMENT

Payment of the order (price and delivery charges) may only be made by the following methods of payment: BANK CARDS, Bancontact (Belgium), VISA, MASTERCARD, MAESTRO, IDEAL, APPLEPAY and PAYPAL.

The Customer's bank account is debited when the order is validated.

5.2 SECURITY OF PAYMENTS

The website www.31degres.be has an SSL security system.
The website www.31degres.be uses the secure payment solution provided by Mollie, a leader in the payment market.

To ensure secure online payment and guarantee the security of your personal data, transaction data is encrypted using SSL technology and transmitted over the Internet. 

As part of its policy of verifying orders and the quality of payments, 31 Degrés Boutique may ask the Customer for a copy of an identity document as well as proof of address. The order will then only be validated after receipt and verification of the documents provided by the Customer.

The Customer guarantees that he/she has the necessary authorisations to use the method of payment chosen by him/her when validating his/her order.

5.3 INVOICING

A detailed invoice, printable from the Customer's account, is available from the time of delivery of the Products ordered.

5.4 DISPUTE OR REFUSAL OF PAYMENT

In the case of refusal of payment to 31 Degrés Boutique by a banking institution, 31 Degrés Boutique reserves the right to (1) suspend the processing and delivery of the disputed order or (2) refuse or cancel the order of the Customer with whom there is already an ongoing dispute relating to the payment of an order.

Article 6 - ORDER

Orders are placed exclusively on the www.31degres.be website by following the instructions given there. As a reminder, the Customer declares that he/she has read and accepted the General Terms and Conditions of Sale before formalising his/her order. Any order validated by the Customer using the ‘double click’ procedure ((i) placing the order and (ii) the possibility of modifying it before confirming it by clicking on the (VALIDATE and PAY) button) constitutes irrevocable acceptance of the order subject to the specific provisions of the GTC such as the right of withdrawal or the unavailability of stocks. The data recorded by 31 Degrés Boutique and its information systems constitute proof of all transactions between 31 Degrés Boutique and the Customer. As soon as the order has been validated, 31 Degrés Boutique sends the Customer a confirmation e-mail summarising the entirety of the order.

Article 7 - DELIVERY

7.1 DELIVERY TERMS

Packages are only delivered to the countries listed at the time of ordering.
Deliveries are carried out via the services of GLS, Bpost, Mondial Relay or another company chosen by 31 Degrés Boutique.
The Products are delivered to the address indicated by the Customer at the time of each order. If the Customer wishes to have the Products delivered to different addresses, separate orders must be placed.

31 Degrés Boutique sends each Customer an e-mail notifying them that their order has been dispatched.

7.2 DELIVERY TIMES

Delivery times are generally 24 to 72 working hours in Belgium and 2 to 5 working days for French and Dutch customers. For other customers based in the European Union, the delivery time is 3 to 6 working days.
Orders are dispatched within 24h/48h after validation.

Delivery times for ‘available on order’ items are between 7 and 15 working days (see point 3.3).
You will also be reminded of this in the order confirmation e-mail we send you. 
You will receive a tracking number for the parcel once it has been dispatched to the address you have given.

31 Degrés Boutique agrees to deliver products in accordance with the average delivery time indicated on the site for each product. If no delivery time is indicated, the delivery time for the product may not exceed thirty (30) days after confirmation of the order.
An e-mail will inform the Customer of any delay in delivery.

7.3 SUIVI DES LIVRAISONS

Each Customer can follow the status of the processing of their order by 31 Degrés Boutique via the tracking number they have received. 

7.4 DELAY IN DELIVERY

If the average delivery time indicated is not respected, the Client may cancel the contract, by registered letter with acknowledgement of receipt or by a written document on another durable medium, if, after having enjoined 31 Degrés Boutique, in the same manner, to carry out the delivery within a reasonable additional time, the latter has not done so within this time. The contract is considered to have been terminated on receipt by 31 Degrés Boutique of the letter or written document informing it of this termination, unless the professional has performed in the meantime. The Client will then be reimbursed under the conditions set out in the paragraph ‘Reimbursement of Products’ in the Article ‘RIGHT OF WITHDRAWAL’.

If the average delivery time indicated to the Customer is not respected and if it appears that this delivery time constitutes an essential condition of the contract for the Customer, the Customer may immediately cancel the contract. This essential condition results from the circumstances surrounding the conclusion of the contract or from an express request made by the Customer before the conclusion of the contract. In this case, the contract will be considered to have been terminated upon receipt by 31 Degrés Boutique of the letter or writing informing it of this termination. In the event of termination due to late delivery of the product(s), 31 Degrés Boutique undertakes to reimburse the Customer for all sums paid, at the latest within fourteen (14) days following the date on which the Customer terminated the contract.

En cas de circonstances imprévues (ex : conditions météorologiques défavorables), il est possible que nous ne soyons pas en mesure de livrer les marchandises dans les délais établis. Si le retard est dû entièrement ou partiellement aux circonstances mentionnées ci-dessus, nous ne pouvons être tenu responsable du retard ou de la non-livraison des biens. En cas de non-livraison, nous conviendrons avec vous d’une date de livraison alternative. Nous ne sommes pas responsables du retard de livraison dû à l’indisponibilité d’un individu pour recevoir les marchandises. Il relève de votre responsabilité de contacter le bureau de poste ou transporteur afin de vous renseigner sur les biens n’ayant pas pu être livrés en raison de votre indisponibilité.

7.5 NON-RECEIPT OF PACKAGES

If, at the time of delivery to the address indicated by the Customer, the latter is not present or refuses the parcel, the parcel will be deposited at the ‘parcel shop’ closest to the Customer's home, where the Customer will be able to collect it during a period determined by the transport company, on presentation of the delivery notice deposited by the transporter in the Customer's letterbox.

At the end of this period, the carrier returns any unclaimed package to 31 Degrés Boutique.

If a parcel is returned to 31 Degrés Boutique for a reason attributable to the Customer, such as an ‘unclaimed’ parcel or ‘does not live at the address indicated’, 31 Degrés Boutique will inform the Customer concerned by e-mail.

In this case, with the Customer's agreement, the parcel will be resent, the costs of resending being borne by the Customer. An e-mail will inform the Customer of the procedure to follow for payment of these delivery costs.

In all other cases, the parcel will be kept by 31 Degrés Boutique for sixty (60) days. At the end of this period, 31 Degrés Boutique may decide to keep the Products thus returned, without notice or formal notice. This does not give the Customer any right to reimbursement, replacement or compensation. The Customer will not be reimbursed for either the price of the order or the delivery costs.

7.6 DAMAGED PRODUCT ON DELIVERY

In the case where the Products are delivered damaged, the Customer must imperatively notify this fact to the transport company and to 31 Degrés Boutique by registered letter with acknowledgement of receipt within forty-eight (48) hours (working hours) following delivery of the parcel.

This complaint must be justified and describe in particular the state in which the Products and their packaging were delivered to the Customer.

It is recommended that the package be examined in the presence of the delivery person and that any reservations be noted on the delivery note, a copy of which should be retained by the Customer.

Within this same period of forty-eight (48) hours, the Customer must send a duplicate of its complaint to the Customer Service of the Internet Site www.31 degres.be, by e-mail or by registered letter with acknowledgement of receipt, to the addresses shown in the Article ‘Customer Service and complaints’ of the GTC.

31 Degrés Boutique will then contact the Customer by email in order to organise the return of the Products at 31 Degrés Boutique's expense. In addition, the Customer will have the following choice:

  • maintain their order and obtain a new delivery (unless the Product is unavailable), which will start a new delivery period, or,
  • cancel the order, 31 Degrés Boutique proceeding to reimburse the price paid under the terms and conditions defined in the paragraph ‘Reimbursement of Products’ of the Article ‘RIGHT OF WITHDRAWAL’.

Article 8 - RIGHT OF WITHDRAWAL

The Customer has fourteen (14) days from receipt of the products to exercise his right of withdrawal, without having to justify himself or pay any penalty, by writing to the address below:

8.1 EXERCISE OF THE RIGHT OF WITHDRAWAL

The Customer must inform 31 Degrés Boutique, within a period of fourteen (14) days, of his decision to withdraw by informing :

by any written means (letter, e-mail, fax) expressing his/her wish to withdraw; or

In the case of an order for several products delivered separately, the Customer has a withdrawal period of fourteen (14) days from receipt of the last product.

The return costs are at the Client's expense.

31 Degrés Boutique agrees to do its best to reply to the Customer as soon as possible.

When the Customer exercises his right of withdrawal, the Customer undertakes to return the Products at the latest within fourteen days of communicating his decision to withdraw. Failing this, the right of withdrawal shall have no effect and the sale shall be final.

The Products must be returned intact, clean and complete (i.e. in perfect condition for resale, unmodified and in their original packaging), accompanied by any instructions and accessories.

The Customer must return the Products, clearly indicating the invoice number or the returns number allocated to them on the parcel. The Customer must also include a copy of the invoice in the parcel.

It is the responsibility of the Customer exercising his/her right of withdrawal to reserve proof of the return of the goods by him/her (presentation of a recorded delivery receipt, presentation of a document provided by the carrier, etc.).

Before refunding, 31 Degrés Boutique reserves the right to carry out the necessary checks in the event of a discrepancy between the Products returned and the invoice enclosed or the returns number.

8.2 REFUNDS

The Customer will be reimbursed for an amount equal to the price of the Products returned plus the delivery costs paid by the Customer in respect of the denounced order, with the exception of additional delivery costs if the Customer has expressly chosen a more expensive delivery method than the standard delivery method offered by 31 Degrés Boutique. The cost of returning Products, the maximum amount of which is indicated above, will remain payable by the Customer.

This refund will be credited to the bank account from which the payment received by 31 Degrés Boutique was issued.

Reimbursement will be made at the latest within fourteen (14) days from the date on which 31 Degrés Boutique was informed of the Customer's decision to withdraw, subject to receipt of the products in good condition or provision by the Customer of proof of effective dispatch of the products. 31 Degrés Boutique will make the reimbursement using the same means of payment as that used by the Customer when validating the order, unless the Customer expressly agrees to the reimbursement of the sum by another means of payment and insofar as the reimbursement does not incur any costs for the Customer.

FORCE MAJEURE

En cas de force majeure, nous ne sommes pas tenus de respecter nos obligations à l’égard des consommateurs. Dans ce cas, nous avons soit le droit de suspendre nos obligations pour la durée de l’événement de force majeure, soit d’annuler définitivement votre commande.

Force majeure is any circumstance beyond our control that makes it wholly or partially impossible for us to fulfil our obligations to you. These circumstances include strikes, lock-outs, industrial disputes, fire, technical incidents, power failures, disruptions to the (telecommunications) networks or lines or other communication systems used and/or the non-availability of our Website, non-delivery or late delivery by suppliers or other third parties, etc.

Article 9 - CUSTOMER SERVICE AND COMPLAINTS

The Website's Customer Service is available to provide information from Monday to Friday:

31 Degrés Boutique agrees to do its best to reply to the Customer as soon as possible.

Article 10 - LIABILITY

31 Degrés Boutique may not be held liable and 31 Degrés Boutique may not under any circumstances be held liable for damages of any kind, whether material, immaterial, indirect or physical, which may result from :

  • improper use of the Products by the Customer, contrary to custom, the usual rules of caution and the information leaflets provided,
  • an inadequacy between the photographs and texts reproduced illustrating the Products offered and their characteristics, communicated by way of illustration and non-contractual.

31 Degrés Boutique may not be held liable in the event of a force majeure event, i.e. an irresistible and unforeseeable event.

Article 11 - MISCELLANEOUS

11.1 INVALIDITY OR ILLEGALITY OF A CLAUSE

If any provision of these GTC is found to be invalid or unlawful, the validity and legality of the remaining provisions shall not be affected.

11.2 INTELLECTUAL PROPERTY RIGHTS

All texts, comments, works, illustrations, images and any other element appearing on the www.31degres.be Internet Site are the full and entire property of 31 Degrés Boutique. As such, any reproduction, representation, modification, adaptation or use of any of these elements is prohibited and constitutes an infringement which may incur the civil and criminal liability of the counterfeiter.

11.3 PERSONAL DATA

The information and personal data communicated by the Customer to 31 Degrés Boutique are intended to be used by the internal departments of 31 Degrés Boutique and by its service providers, for the purposes of processing the Customer's Order. 31 Degrés Boutique may communicate this information to third parties.
31 Degrés Boutique may propose offers to its customers who so wish. In such cases, 31 Degrés Boutique guarantees the confidentiality of customer information.

11.4 DISPUTE RESOLUTION AND APPLICABLE LAW

These GTC are subject to Belgian law.
Nevertheless, in the event of a dispute, the Customer will have the option of seeking an amicable solution to the dispute, as a priority to any legal action. The Customer may then contact the Customer Service department, whose contact details are given in the article entitled ‘CUSTOMER SERVICE AND COMPLAINTS’.
In the absence of a prior amicable settlement between 31 Degrés Boutique and the Customer, all disputes arising in the context of the relationship between the Customer and 31 Degrés Boutique will be submitted to the competent courts.
